Traffic Laws in Bell County
All Texas traffic laws apply in Bell County. The Transportation Code governs vehicle operation on public roads. Chapter 545 covers speed limits under Sec. 545.351, lane use, following distance, passing rules, and cell phone restrictions under Sec. 545.419. I-35 through Bell County has both state and local enforcement, with varying speed zones through Waco, Temple, and Killeen. Reckless driving under Sec. 545.401 is more serious than a basic citation and can result in a harder-to-dismiss case.
Citations must be on the uniform form set out in Transportation Code Chapter 543. Section 543.005 requires officers to keep records of all citations issued. City ordinance violations in Killeen or Temple go through those cities' municipal courts, not the JP courts. If your citation says "City of Killeen" or "City of Temple," contact that city's municipal court.
When you get a citation, respond by the appearance date. You can appear in person, by mail, or through an attorney. Phone calls and emails are not valid appearances, as explained at TexasCourtHelp.gov. If mailing your response, the envelope must be postmarked by the appearance date.
Driver Safety Course in Bell County
Eligible defendants in Bell County can request a Driver Safety Course (DSC) to get a traffic citation dismissed. Request this at or before your court date at the JP court or municipal court that issued your citation. If approved, complete an approved 6-hour course and submit a certified Type 3A driving record from Texas DPS within 90 days. The driving record costs $10 by mail or $12 online.
DSC is not available for CDL holders, reckless driving, leaving the scene of an accident, passing a school bus, or construction zone violations with workers present. Deferred disposition is also available in many Bell County cases. You pay the fine up front, serve a probation period without new violations, and the case is dismissed.
